Earbud caused serious pain and damaged hearing?

When earplugs fail to perform as designed to eliminate noise and protect workers from loud explosive sounds the product maker can be held liable. Moreover, lawsuits are warranted where people have lost hearing due to a defect in earbuds, or when instructions fail to warn of dangers associated with prolonged high-volume listening.

Tiny objects can lead to big injuries. For example, everyone is familiar with using earbuds to listen to music or podcasts. The earbud is a small product. But it can cause a big injury.

There have been reported cases where people have lost hearing due to a defect in such products, or due to poor instructions that failed to warn of dangers associated with prolonged high-volume listening.

Earbuds can lead to infection of the ear if they are not sanitized properly between use. Most manufacturers fail to warn of this danger which is not apparent to users.

What if earplugs which are designed to eliminate noise and protect workers from loud explosive sounds fail?

There are lawsuits against 3M right now for defective earplugs sold for use by soldiers that failed to protect against exposure to injury from loud noises encountered by the soldiers. Some soldiers experienced a partial loss of hearing, and others an almost total loss of hearing.

When even a small product, because of a manufacturing defect, a failure to warn, or inadequate instruction, causes injury the manufacturer and seller of the item can be held legally responsible for injuries resulting from use of the product.

Product size does not matter. Manufacturers who have sold toys with small parts that a child can swallow have been held responsible for such harm flowing from their products.
