Taxi Passenger Injury

I’m Indiana personal injury attorney David Holub.

What if you’re injured as a passenger in a taxicab that collides with another vehicle?

Well, there’s going to be some issues that develop which are a little bit different than most car accident cases. First, you’ll have to try to establish the fault of the driver of the taxi, then you’re going to try to see if there’s fault on the part of the other driver that collided with the taxi.

The key difference is going to be in insurance coverage, where taxis are normally covered by fleet policies, which can be up to a million dollars.

However, if there are multiple passengers in a taxi, or in multiple cars that are involved in a collision, could easily exceed that coverage if there is serious injury to a number of people.

This often happens in bus crashes.

Buses are normally covered by fleet policies with a million dollars of coverage, but there’s usually a lot of passengers in a bus compared to the number of passengers that can fit into a taxi.

Are taxi cabs held to the same standard of common carrier liability as buses, trains, and planes?

The answer is often yes.

Common carriers are held to a higher standard, and are frequently held to a standard that basically says they ensure passenger safety. It’s not one hundred percent, but it’s just higher than the normal negligence standard.

So you have to deal with these type of issues when there’s an injury to a bus passenger, and you’re probably going to have to deal with a similar sort of issues if you’re dealing with an injury to a taxicab passenger, which is keeping in mind the coverage limits and trying to establish which driver is at fault. Obviously, the passenger has no fault, but the drivers of both vehicles could have fault or share fault.
