What Happens at My Deposition

Transcript: Hi. I’m Indiana personal injury attorney David Holub.

Giving your testimony under oath at a deposition may seem like a daunting task, especially if you’re concerned that the defense counsel may be mean or nasty.

Our advice, however, is to try not to worry about the person who’s asking the questions, just simply try to listen to your attorney and follow your attorney’s advice and listen to the questions and answer them as best you can. Our practice is to always get our clients in in advance of a deposition, and give them a thorough opportunity to prepare for that deposition.

Sometimes we have them watch videos, sometimes we go through a mock question-and-answer session so that they begin to feel what it’s like to have to answer questions under pressure.

Sometimes those mock sessions will result with a person acting the part of a defense counsel being very mean, but also sometimes those sessions show a defense counsel acting very nice and polite because sometimes politeness can put you off guard, and you start to think this is an easy task. In any event, whichever situation you have, a mean defense attorney or a nice defense attorney, or somewhere in-between, we will prepare you well in advance of a trial on how to answer questions truthfully, honestly, accurately, and carefully.

Also, during a deposition, your attorneys will be there as your advocate to object, if necessary, to call a break session, if necessary. We’ll be there to help you through the process.
