Medical Malpractice Law Changes 2016

On March 24, 2016, Governor Mike Pence signed into law a bill which will increase Indiana’s medical malpractice cap.  The good news is that the caps were increased.  The bad news is the increases are only slight.

Currently, Indiana has a set maximum amount of $1.25 million that a person can recover for a medical malpractice claim.  This maximum hasn’t changed in over 18 years, although other states have raised their caps to account for inflation and rising health care costs.  Feeling pressure to raise the caps after other states’ caps were ruled unconstitutionally low and/or unfair, Indiana’s legislators ultimately decided on a modest increase to $1.65 million in 2017 and then to $1.8 million in 2019.
