This video discusses the common question we have and that is “why isn’t my case worth the same value of this other case that I’ve heard about.”
Well, the circumstances in most cases are actually different even though you think they are the same, but let’s run through some of it.
One of the first things would be your case will be tried in front of a different jury and a different community from the case that you’ve heard about. In other words, will the same jury that gave that big verdict be the jury in your case? No. It will be a different jury.
Attorneys know that if you present the same facts to different juries, you are going to get different results. Are you the same age as the peson in the big case that you’ve heard about?
It makes a huge difference. If you’re 20 years old and you have a 60 year life expectancy of suffering in pain and the other person is 60 years old and has a 20 year life expectancy of suffering in pain, it can make a big difference between values on cases and what juries might decide to appraise as to the value of your claim. Also when you hear about big verdicts, you have to keep in mind that the news only reports big verdicts.
You don’t hear the news reporting about small, little verdicts. It’s just not news.
So the information you’re getting is skewed.
Attorneys know the full range of verdicts that are decided, not just the big ones that have a lot of publicity. You also have to consider whether the case that you have has the same level of ongoing medical care and treatment and expenses as the big case that you heard about. Additionally, you need to have information about whether the big case had lots of lost earning information or other information as to damages that your case does not have.
For example, a broken arm to an athelete that’s paid to throw a ball can be worth a whole lot more in terms of damages than an arm to an office worker who can get by typing for a time while that arm heals.
